Toye Properties LLC respects valid existing listing agreements, buyer representation agreements, and other brokerage agreements between property owners and licensed real estate professionals.

You represent and warrant that you will promptly disclose to Toye Properties LLC if a property you are inquiring about is currently listed for sale, under contract, or otherwise subject to an agreement with a real estate broker or agent. In those situations, Toye Properties LLC may communicate through the listing broker or agent, request that you involve your broker or agent in discussions, decline to proceed unless the proper parties are included, or withdraw any offer previously made. Nothing on this website or in our communications is intended to encourage any seller to breach, avoid, or interfere with any valid agreement with a real estate broker, agent, or other third party.

Any real estate commission, brokerage fee, referral fee, or other compensation owed to a broker or agent will be handled according to the applicable written agreements, purchase contract, closing documents, and applicable law. Toye Properties LLC is not responsible for paying any broker, agent, or third-party compensation unless expressly agreed to in a signed written agreement.

By submitting your contact information through this website, by contacting us, or by responding to outreach from us and agreeing to continued contact, you expressly consent to receive communications from Toye Properties LLC and its service providers, including:

You and Toye Properties LLC each agree that any Dispute will be brought in an individual capacity only, and not as a plaintiff or class member in any purported class, collective, or representative action. The arbitrator may not consolidate claims or preside over any form of representative or class proceeding.

Exceptions. Either party may bring an individual action in small-claims court for qualifying disputes, and either party may seek injunctive or equitable relief in court to protect intellectual property or confidential information.

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. For any matter not subject to arbitration, the parties consent to exclusive jurisdiction and venue in the state and federal courts located in Denton County, Texas.

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to make it enforceable while preserving its intent.

These Terms, together with the Privacy Policy and any other agreements expressly referenced here, constitute the entire agreement between you and Toye Properties LLC concerning your use of this website and supersede any prior or contemporaneous agreements, communications, and proposals on the same subject.
